If there is any difference between this translation and the Japanese version, the Japanese version prevails.

Article 1 (Scope)

Accommodation contracts and related contracts concluded between HANZ OUTDOOR RESORT KAWAGUCHIKO (the “Resort”), operated by HANZ Golf & Resort Co., Ltd. (株式会社ハンズゴルフ&リゾート), and its guests are governed by these Terms. Matters not covered by these Terms are governed by laws and regulations (meaning laws and any rules made under them; the same applies below) or by generally established practice.

If the Resort agrees to a special arrangement that does not conflict with laws, regulations or practice, that arrangement takes priority over paragraph 1.

In these Terms, “Unit” means a villa, dome tent, outdoor residence or other building the Resort provides for accommodation, together with its terrace, deck and private outdoor space.

Article 2 (Application for Accommodation)

A person applying to the Resort for an accommodation contract must give the Resort the following information:

the names of the guests;

the dates of stay and expected time of arrival;

the accommodation charges (in principle, the basic accommodation charges in Schedule 1);

the number of guests (adults and children), and whether any pet will stay, with the number of pets and their weight; and

any other information the Resort considers necessary.

If a guest asks during the stay to extend it beyond the dates in item 2 of paragraph 1, the Resort will treat the request as a new application for accommodation made at that time.

Article 3 (Conclusion of the Contract)

The accommodation contract is concluded when the Resort accepts the application in Article 2, unless the Resort proves that it did not accept it.

When the contract has been concluded, the guest must pay a deposit set by the Resort, not exceeding the basic accommodation charges for the period of stay (or for three days if the stay is longer than three days), by the date the Resort specifies.

The deposit will be applied first to the accommodation charges finally payable by the guest; if Article 6 or Article 18 applies, it will be applied to the cancellation charge and then to damages. Any balance will be returned when charges are settled under Article 12.

If the deposit is not paid by the date specified under paragraph 2, the contract ceases to have effect, but only if the Resort told the guest of this when it specified the payment date.

If a guest books, through the reservation system on the Resort’s official website, a plan for which all or part of the charges are paid online at the time of booking, that advance payment is treated as the deposit under paragraph 2.

Article 4 (Special Arrangement Waiving the Deposit)

Notwithstanding Article 3(2), the Resort may agree to a special arrangement under which no deposit is required after the contract is concluded.

If, when accepting an application, the Resort does not ask for the deposit under Article 3(2) or does not specify a payment date for it, the Resort is treated as having agreed to the arrangement in paragraph 1.

Article 4-2 (Request for Cooperation with Infection Control)

The Resort may ask a person who intends to stay for the cooperation provided for in Article 4-2(1) of the Hotel Business Act (Act No. 138 of 1948).

Article 5 (Refusal to Conclude a Contract)

The Resort may refuse to conclude an accommodation contract in the following cases. This Article does not mean that the Resort may refuse accommodation in any case other than those set out in Article 5 of the Hotel Business Act.

The application does not follow these Terms.

No Unit is available because the Resort is fully booked.

The person intending to stay is considered likely to act, in connection with the stay, against laws and regulations, public order or good morals.

The person intending to stay is considered to fall under any of the following:

(a) an organised crime group as defined in Article 2(2) of the Act on Prevention of Unjust Acts by Organised Crime Group Members (Act No. 77 of 1991) (“Organised Crime Group”), a member of an Organised Crime Group as defined in Article 2(6) of that Act (“Organised Crime Group Member”), a quasi-member or associate of an Organised Crime Group, or any other anti-social force;

(b) a corporation or other organisation whose business activities are controlled by an Organised Crime Group or Organised Crime Group Member; or

(c) a corporation with an officer who is an Organised Crime Group Member.

The person intending to stay has behaved in a way that seriously disturbs other guests.

The person intending to stay is a patient or other person with a specified infectious disease as defined in Article 4-2(1)(ii) of the Hotel Business Act (“Person with a Specified Infectious Disease”).

Violent demands are made in connection with the stay, or a burden beyond a reasonable scope is demanded (except where the person asks for the removal of a social barrier under Article 7(2) or Article 8(2) of the Act for Eliminating Discrimination against Persons with Disabilities (Act No. 65 of 2013) (the “Disability Discrimination Act”)).

The person intending to stay has repeatedly made demands of the Resort that impose an excessive burden and are likely to seriously obstruct the provision of accommodation services to other guests, as specified in Article 5-6 of the Enforcement Regulations of the Hotel Business Act.

The Resort cannot provide accommodation because of a natural disaster, failure of facilities, severe weather or other unavoidable cause.

The case falls under Article 6 of the Yamanashi Prefecture Ordinance for Enforcement of the Hotel Business Act (the person intending to stay is intoxicated and is considered likely to cause serious nuisance to other guests).

Article 5-2 (Explanation of Refusal)

If the Resort refuses to conclude an accommodation contract under Article 5, the person intending to stay may ask the Resort to explain the reason.

Article 6 (Cancellation by the Guest)

A guest may cancel the accommodation contract by notifying the Resort.

If a guest cancels all or part of the contract for a reason attributable to the guest, the Resort will charge a cancellation charge as set out in the cancellation policy shown for the plan booked at the time of booking (the “Cancellation Policy”). This does not apply where the Resort specified a deposit payment date under Article 3(2) and the guest cancels before paying the deposit. Where the Resort agreed to the arrangement in Article 4(1), the cancellation charge applies only if the Resort told the guest of the obligation to pay it when agreeing to that arrangement.

If a guest does not arrive by 8:00 p.m. on the day of the stay (or, if an expected arrival time was given, by two hours after that time) without contacting the Resort, the Resort may treat the contract as cancelled by the guest.

For contracts booked through an online travel agency or other third party, cancellation procedures and payment of cancellation charges may follow that third party’s procedures.

Article 7 (Cancellation by the Resort)

The Resort may cancel the accommodation contract in the following cases. This paragraph does not mean that the Resort may refuse accommodation in any case other than those set out in Article 5 of the Hotel Business Act.

The guest is considered likely to act, or is considered to have acted, in connection with the stay, against laws and regulations, public order or good morals.

The guest is considered to fall under any of the following:

(a) an Organised Crime Group, Organised Crime Group Member, quasi-member or associate of an Organised Crime Group, or any other anti-social force;

(b) a corporation or other organisation whose business activities are controlled by an Organised Crime Group or Organised Crime Group Member; or

(c) a corporation with an officer who is an Organised Crime Group Member.

The guest has behaved in a way that seriously disturbs other guests.

The guest is a Person with a Specified Infectious Disease.

Violent demands are made in connection with the stay, or a burden beyond a reasonable scope is demanded (except where the guest asks for the removal of a social barrier under Article 7(2) or Article 8(2) of the Disability Discrimination Act).

The guest has repeatedly made demands of the Resort that impose an excessive burden and are likely to seriously obstruct the provision of accommodation services to other guests, as specified in Article 5-6 of the Enforcement Regulations of the Hotel Business Act.

The Resort cannot provide accommodation because of a natural disaster, severe weather or other force majeure.

The case falls under Article 6 of the Yamanashi Prefecture Ordinance for Enforcement of the Hotel Business Act.

The guest smokes inside a Unit, uses fire outside the designated places, tampers with firefighting equipment, or otherwise fails to comply with the prohibitions in the Resort’s rules (limited to those necessary to prevent fire).

If the Resort cancels the contract under paragraph 1, it will not charge for accommodation or other services the guest has not yet received.

Article 7-2 (Explanation of Cancellation)

If the Resort cancels an accommodation contract under Article 7, the guest may ask the Resort to explain the reason.

Article 8 (Registration)

On the day of the stay, guests must register the following at the Resort’s front desk:

each guest’s name, address and contact details;

for foreign nationals without an address in Japan, nationality and passport number; and

any other information the Resort considers necessary.

As required by law, the Resort will ask foreign guests without an address in Japan to show their passports and will keep a copy.

A guest who intends to pay the charges under Article 12 by accommodation voucher, credit card or other substitute for cash must present it at registration under paragraph 1.

Article 9 (Hours of Use of Units)

Guests may use their Unit from 3:00 p.m. until 10:00 a.m. the following morning. For consecutive nights, guests may use the Unit all day except on the days of arrival and departure.

Notwithstanding paragraph 1, the Resort may allow use of a Unit outside these hours, in which case an additional charge set by the Resort will apply.

Article 10 (Compliance with Resort Rules)

While at the Resort, guests must follow the rules set by the Resort and posted on site or provided in the Units.

These rules include the following:

Fire pits, barbecues and any other use of fire are permitted only with the equipment and in the places designated by the Resort, following staff instructions. Guests must stop using fire when the Resort judges it unsafe, for example in strong wind. Guests are responsible for fully extinguishing any fire.

Smoking is not permitted inside the Units and is allowed only in designated places.

Fireworks may not be used. Guests may not bring or use any fire source, fuel or other item the Resort considers dangerous unless the Resort has approved it.

Between 10:00 p.m. and 7:00 a.m., guests must keep conversation, music and other noise outdoors to a low level out of consideration for other guests and neighbours.

Pets are limited to dogs weighing 11 kg or less and are permitted only in the two villas designated by the Resort as pet-friendly. Guests must tell the Resort about any pet when booking and follow the Resort’s separate pet rules. This does not apply to assistance dogs under the Act on Assistance Dogs for Persons with Physical Disabilities.

The private hot-spring baths, sauna, jacuzzi and other facilities must be used in accordance with the Resort’s instructions and precautions.

When using outdoor facilities, guests must take care with the weather, footing, wildlife and insects, and follow staff instructions.

Without the Resort’s permission, guests may not use a Unit for any purpose other than accommodation or allow more people to stay than were booked.

Article 11 (Business Hours)

The business hours of the Resort’s main services are as follows. Detailed hours of other facilities are given in notices on site and in the information provided in the Units.

Front desk services: check-in from 3:00 p.m., check-out by 10:00 a.m.

Dining, private hot-spring baths and other facilities: as shown in the notices or guest information.

These hours may be changed temporarily because of weather, season, equipment inspection or other unavoidable reasons. Guests will be informed by appropriate means.

Article 12 (Payment)

The breakdown of charges payable by the guest is set out in Schedule 1.

Charges must be paid at the front desk, in cash or by accommodation voucher, credit card or other method accepted by the Resort, on arrival or when the Resort requests payment. For plans paid in advance, payment is made online at the time of booking; for bookings through an online travel agency, payment is made by the method that agency specifies.

Once the Resort has made a Unit available to the guest, the accommodation charges are payable even if the guest chooses not to stay.

Article 13 (Liability of the Resort)

The Resort will compensate the guest for damage caused in performing, or by failing to perform, the accommodation contract or a related contract, unless the cause is not attributable to the Resort.

The Resort is covered by hotel liability insurance in case of fire or similar events.

Article 14 (When the Contracted Unit Cannot Be Provided)

If the Resort cannot provide the contracted Unit, it will, with the guest’s agreement, arrange another Unit or other accommodation on conditions as close as possible to the original.

If the Resort cannot arrange other accommodation despite paragraph 1, it will pay the guest compensation equal to the cancellation charge, which will be applied towards damages. No compensation is payable if the Resort is not responsible for the inability to provide the Unit.

Article 15 (Items Deposited with the Resort)

The Resort will compensate the guest for loss of or damage to goods, cash or valuables deposited at the front desk, except where caused by force majeure. However, for cash and valuables, if the Resort asked the guest to declare their type and value and the guest did not do so, the Resort’s liability is limited to 150,000 yen.

The Resort will compensate the guest for loss of or damage to goods, cash or valuables brought into the Resort but not deposited at the front desk, if caused intentionally or negligently by the Resort. However, for items whose type and value the guest did not declare in advance, the Resort’s liability is limited to 150,000 yen, unless the Resort acted intentionally or with gross negligence.

Article 16 (Custody of Baggage and Belongings)

If a guest’s baggage arrives at the Resort before the guest, the Resort will look after it only if it agreed to do so before the baggage arrived, and will hand it over when the guest checks in at the front desk.

If a guest’s baggage or belongings are left at the Resort after check-out and the owner is identified, the Resort will contact the owner and ask for instructions. If the owner gives no instructions or cannot be identified, the Resort will keep the items for seven days including the day they were found and then hand them to the nearest police station.

The Resort’s liability for items kept under paragraph 1 is governed by Article 15(1), and for items kept under paragraph 2 by Article 15(2), applied with the necessary changes.

Article 17 (Parking)

When a guest uses the Resort’s car park, the Resort only provides the space and is not responsible for looking after the vehicle, whether or not the vehicle key has been left with the Resort. However, the Resort will compensate for damage caused intentionally or negligently by the Resort in managing the car park.

Article 18 (Liability of the Guest)

A guest who causes damage to the Resort intentionally or negligently must compensate the Resort for that damage.

If a pet damages a Unit, equipment, fittings or other guests, the guest who brought the pet must compensate for the damage.

Article 19 (Governing Law and Language)

These Terms and the accommodation contract are governed by and interpreted in accordance with the laws of Japan.

Translations of these Terms into languages other than Japanese are provided for reference only.
